European & United Kingdom Job Applicant Privacy Policy

We (doing business as Cycling Sports Group Europe BV or Cycling Sports Group UK, as applicable) have issued this Privacy Policy (“ Policy “) applicable to all European (including United Kingdom) job applicants (“ you “, “ your “).

We respect the privacy rights of individuals and are committed to handling personal information responsibly and in accordance with applicable law.   1. Types of personal information we collect about job applicants

    • In the course of your application for employment, we may process personal information about you and your dependents, beneficiaries and other individuals whose personal information has been provided to us.

    • The types of personal information we process include, but are not limited to:

      • Identification data e.g., name, gender, date of birth, age, signature, personnel number;

      • Contact details e.g., home address, telephone/email, emergency contact details;

      • Employment details e.g., start date, job title/position, office location, employment contract and type, performance and disciplinary records, salary/wage expectation, references from previous employers, interview notes, previous work history.

      • Professional qualifications achievements and skills information e.g., academic/professional qualifications, education, CV/resume, languages, professional memberships, and academic transcripts;

      • National identifiers e.g., national ID/passport, driver’s license, tax ID number;

      • Religion/religious beliefs; and

      • Criminal records checks and references/background checks.

  2. Sources of personal information

    • Usually you will have provided the information we hold about you but there may be situations where we collect personal information from other sources, such as references from nominated third parties and background checks.

  3. Purposes for processing personal information

    • We will collect and use your personal information for the purpose of considering your application for employment.

    • We may also collect and use personal information when it is necessary for other legitimate purposes, such as to help us conduct our business more effectively and efficiently. We may also process your personal information to investigate breaches of law or of our own internal policies.

    • We may also use your personal information where we consider it necessary for complying with laws and regulations, including collecting and disclosing information as required by law (e.g., for tax, health and safety, anti-discrimination laws), under judicial authorization, or to exercise or defend the legal rights of our global group of companies.

  4. Who we share your personal information with

    • We take care to allow access to personal information only to those who require such access to perform their tasks and duties, and to third parties who have a legitimate purpose for accessing it. Whenever we permit a third party to access personal information, we will implement appropriate measures to ensure the information is used in a manner consistent with this Notice and that the confidentiality and integrity of the information is maintained.

    • We may share your personal information with other members of our group of companies around the world to administer your application.

    • We make certain personal information available to third parties who provide IT and application related services to us. We do so on a “need to know basis” and in accordance with applicable data protection law.

    • We may also disclose personal information to other third parties on other lawful grounds, including:

      • To comply with our legal obligations, including where necessary to abide by law, regulation or contract, or to respond to a court order, administrative or judicial process, or to meet national security or law enforcement requests, including, but not limited to, a subpoena or search warrant;

      • With your consent;

      • As necessary to establish, exercise or defend against potential, threatened or actual litigation;

      • Where necessary to protect the vital interests of another person; and

      • In connection with the sale, assignment or other transfer of all or part of our business.

  5. Transfer of your personal information outside of Europe

    • We are part of a global group of companies, including some in the USA and since we operate at a global level, we may need to transfer personal information to other countries for management purposes. Transfers may also need to be made to other countries where we operate (such as information on relevant experience you may have for a particular job or secondment). When we export your personal information to a different country, we will take steps to ensure that such data exports comply with applicable laws and legislation. For example, for transfers of personal information from the European Economic Area (EEA) to our affiliated group entities located outside of the EEA, we have implemented intra-group Standard Contractual Clauses approved by the European Commission to enable the transfer of personal information. These clauses are contractual commitments between our group companies binding them to protect the privacy and security of EEA personal information.

    • Likewise, when we use third-party service providers and their services involve transfers of personal information outside of the EEA, we ensure that the third-party service provider has appropriate data transfer mechanisms in place.

  6. Data retention periods

    1. Personal information will be stored only as long as we deem necessary to carry out the purposes described in this Notice or as otherwise required by contractual agreements with third parties, law or our other policies.

  7. Rights which job applicants have regarding their personal information

    • Job applicants in the EEA, have the following data protection rights, which you can exercise by contacting us using the details below:

      • The right to access, correct, update or request deletion of your personal information.

      • The right to object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.

      • The right, if we have collected and processed your personal information with your consent, to withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

        • We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.

        • You also have the right to complain to a data protection authority about our collection and use of your personal information. For more information, please contact your local data protection authority.

  8. Updates to this notice

    • This Notice may be updated periodically to reflect any necessary changes in our privacy practices. Where such changes will materially affect your privacy rights, we will inform you.
